Novel data transmission methods in challenging environments (ZANDER-F)
Die Kommunikation und Bildgebung durch Faraday’sche Käfige wird im Folgenden in fünf Haupteinsatzszenarien (A-E) unterteilt.
Das Ziel der Forschungsausschreibung ist es, einen Prototyp (bis TRL 4) zu liefern, der im besten Fall die unten aufgeführten Eigenschaften für jeden der Einsatzszenarien (Einsatzszenarien sind als denkbare Szenarien zu verstehen) aufweist:
A. Kommunikation durch Metallwände (z. B. Schiffsrümpfe, Container )
B. Bildgebung durch Metallwände (z. B. Schiffsrümpfe, Container)
C. Kommunikation durch Sand/Ton (z. B. Betonwände, unterirdische Tunnel)

E. Erkennung von (kleinen) Drohnen hinter Gebäuden, in städtischen Gebieten und an-deren Bereichen, in denen eine direkte Sichtlinie behindert wird

This tender focuses on research enabling communication, imaging and detection through solid conductive barriers or Faraday cages. Five key operational scenarios (A–E) are presented below, each illustrating a distinct use case. The aim of this research tender is to develop a prototype (up to TRL 4) that ideally demonstrates the following capabilities for each scenario:
A. Communication through metal walls (e.g. ship hulls, containers).
B. Imaging through metal walls (e.g. ship hulls, containers).
C. Communication through sand/clay (e.g. concrete walls, underground tunnels).
D. Imaging through sand/clay (e.g. concrete walls, underground tunnels).
E. Detection of (small) UAVs behind buildings, in urban areas, and other
areas where a direct line of sight is obstructed.

This is a research and development contract that does not fall within the scope of application of public procurement law in application of the exception in Section 116 (1) No. 2 GWB. The contract will be awarded as part of a precommercial procurement procedure based on a competitive dialogue. Details can be found in the document "Tender procedure“.

Research and development services provided under this contract must be carried out entirely in an EU member state or Switzerland and/or in a NATO member state or NATO partner, in particular AP4 (Asia-Pacific partners - South Korea, Japan, Australia and New Zealand). This applies both to the services of the Contractor and to the ser-vices of subcontractors. The Contractor must obtain the prior written consent of the Client for the performance of services in countries other than those specified.
Der Handelsregisterauszug, das Nichtvorliegen von Ausschlussgründen, die wirtschaftliche und finanzielle Leistungsfähigkeit, sowie die technische und berufliche Leistungsfähigkeit sind bei Vorliegen einer Bewerbergemeinschaft für jedes Mitglied der Bewerbergemeinschaft vorzulegen. Beabsichtigt der Bewerber oder ein Mitglied einer Bewerbergemeinschaft, sich zum Nachweis der wirtschaftlichen und finanziellen oder technischen und beruflichen Leistungsfähigkeit auf andere Unternehmen (z. B. durch Subunternehmer) zu berufen, so sind die benannten Unterlagen für die anderen Unternehmen insoweit vorzulegen, als die Bezugnahme auf die Leistungsfähigkeit Dritter erfolgt. Zusätzlich hat der Bewerber mit dem Teilnahmeantrag die Verpflichtungserklärung der anderen Unternehmen vorzulegen, nach deren Inhalt die rechtlich und tatsächlich abgesicherte Verfügbarkeit über die entsprechenden Ressourcen der Dritten nachgewiesen wird. Bei einer Bezugnahme auf Kapazitäten eines anderen Unternehmens im Hinblick auf die wirtschaftliche oder finanzielle Leistungsfähigkeit ist durch dieses ausdrücklich zu bestätigen, dass es mit dem Bewerber im Auftragsfall gemeinsam für die Auftragsdurchführung entsprechend dem Umfang der Eignungsleihe haftet. Beabsichtigt der Bewerber, im Hinblick auf vorzulegende Nachweise für die erforderliche berufliche Leistungsfähigkeit wie Ausbildungs- oder Befähigungsnachweise oder die einschlägige berufliche Erfahrung (Referenzen) die Kapazitäten anderer Unternehmen in Anspruch zu nehmen, so ist durch dieses ausdrücklich zu bestätigen, dass es die Leistungen als Subunternehmer im Auftragsfall erbringen wird, für die diese Kapazitäten benötigt werden.
b) Die Teilnahmeanträge sind in deutscher Sprache einzureichen.
c) Der Auftraggeber hat für die Einreichung der Teilnahmeanträge einen Bewerbungsbogen erstellt. Dieser ist für die Einreichung der Teilnahmeanträge zu verwenden. Die Teilnahmeanträge müssen bis zum Schlusstermin für deren Eingang nach Ziffer 5.1.12 elektronisch via: evergabe-online eingehen. In Papierform eingereichte Bewerbungen werden nicht berücksichtigt. Eine Unterschrift oder Signatur auf dem Bewerbungsbogen ist nicht notwendig, der Name der verantwortlichen Person ist im Unterschriftsfeld jedoch zwingend anzugeben („Textform“).
d) Erläuterung zum Ablauf des Verhandlungsverfahrens:
Die Vergabeunterlagen befinden sich in einem „Entwurfsmodus“ und sollen im Teilnahmewettbewerb noch nicht ausgefüllt werden und dienen lediglich zur Information der Bewerber. Der Auftraggeber behält sich vor, die veröffentlichten informatorischen Vergabeunterlagen anzupassen und den ausgewählten Bewerbern eine überarbeitete Fassung der Vergabeunterlagen, zur Verfügung zu stellen.
e) Die enthaltenen Zeitangaben stehen unter dem Vorbehalt der Anpassung und Aktualisierung.
f) Haushaltsvorbehalt: Die Fortführung dieses Vergabeverfahrens steht unter dem Vorbehalt, dass die erforderlichen Haushaltsmittel in der erforderlichen Höhe zur Verfügung stehen. Sofern sich im Vergabeverfahren herausstellen sollte, dass dies nicht der Fall ist, behält sich die Auftraggeberin vor, das Vergabeverfahren analog zu § 63 Abs. 1 Satz 1 VgV aufzuheben. Kosten und Aufwendungen der Bieter im Zusammenhang mit ihrer Teilnahme am Vergabeverfahren werden auch in diesem Fall nicht erstattet (Sofern nicht vertraglich anders geregelt).
g) Datenschutz: Der Bewerber hat die Bestimmungen der Datenschutz-Grundverordnung, des Bundesdatenschutzgesetzes sowie anderer geltender Gesetze zum Schutz personenbezogenen Daten einzuhalten. Für die Übermittlung personenbezogener Daten an den Auftraggeber trägt der Bewerber die datenschutzrechtliche Verantwortung und hat entsprechend die Rechtmäßigkeit sicherzustellen (z.B. durch Einholung von Einwilligungen bei Angaben natürlicher Personen).

a) Forms of cooperation in this procurement procedure: A current extract from the commercial register, the absence of grounds for exclusion, the economic and financial capacity as well as the technical and professional capacity must be submitted for each member of the consortium in the case of a consortium. If the applicant or a member of a consortium of applicants intends to rely on other companies (e.g. subcontractors) to provide evidence of economic and financial or technical and professional capacity, the specified documents for the other companies must be submitted to the extent that reference is made to the capacity of third parties.
b) Requests to participate can be submitted in German and English.
c) The client has drawn up an application form for the submission of requests to participate. This is to be used for the submission of requests to participate. Requests to participate must be received electronically at evergabe-online by the closing date for receipt in accordance with Section 5.1.12. Applications submitted in paper form will not be considered. A signature is not required on the application form, but the name of the responsible person must be entered in the signature field ("text form").
d) Explanation of the negotiated procedure: The tender documents are in a "draft mode" and should not yet be completed in the participation competition and serve only to inform the applicants. The client reserves the right to adapt the published informational tender documents and to provide the selected applicants with a revised version of the tender documents.
e) The times given are subject to adjustment and updating,
f) Budget reservation: The continuation of this award procedure is subject to the reservation that the necessary budget funds are available in the required amount. Should it become apparent during the award procedure that this is not the case, the client reserves the right to cancel the award procedure in accordance with § 63 (1) sentence 1 VgV. Costs and expenses incurred by applicants / bidders in connection with their participation in the award procedure will not be reimbursed in this case either (unless otherwise contractually agreed).
g) Data protection: The applicant must comply with the provisions of the General Data Protection Regulation (GDPR), the German Bundesdatenschutzgesetz (German Federal Data Protection Act) (BDSG) and other applicable laws on the protection of personal data. The applicant is responsible under data protection law for the transfer of personal data to the client and must ensure that it is lawful.

Bei der vorliegenden Bekanntmachung handelt es sich um die freiwillige EU-weite Bekanntmachung einer vorkommerziellen Auftragsvergabe in Anlehnung an einen Wettbewerblichen Dialog, dass weder in den Anwendungsbereich der Vergaberichtlinien, noch in den Anwendungsbereich des GWB, der VgV oder VSVgV oder des nationalen Vergaberechts fällt. Es handelt sich um einen Forschungs- und Entwicklungsauftrag in Anwendung des Ausnahmetatbestandes § 116 GWB. Keine Doppelförderung (Einzelheiten siehe „Bewerbungsbogen“).
Verfahrensablauf: Stufe 1: Teilnahmewettbewerb & Grobkonzept: Einreichung der Teilnahmeanträge mittels Bewerbungsbogen und Abgabe eines Grobkonzeptes; Stufe 2: Erarbeitung und Einreichung eines Feinkonzepts, Stufe 3: Forschungsphase. Einzelheiten sind dem Dokument „Verfahrensablauf“ zu entnehmen.

Die Auftragswertschätzung ergibt sich aus der Vergütung der Forschungsphase gemäß Verfahrensablauf.

Submission of a current excerpt from the commercial register or an equivalent document or certificate from a competent administrative authority or a court in the applicant's country of origin should be submitted if registration is required due to the applicant's corporate form. The extract from the commercial register must not be older than 6 months. The deadline for the submission of requests to participate specified in this document is decisive. Copy(s) is/are sufficient for the time being.

It must be established that the applicant is in a position to carry out and complete scientific research of the kind that is the subject of the tender procedure in economic and financial terms. To this end, suitable evidence must be provided to ensure economic and financial capacity, e.g. turnover figures for comparable services, details of equity capital, private funding, etc. The overall view of this evidence must show that the suitability criterion has been met. Please note that the application form provided by the client must be used.

Proof must be provided that the applicant has a project team available that is capable of carrying out and completing scientific research of the kind that is the subject of this award procedure. To this end, suitable evidence of the scientific staff must be provided, such as corresponding CVs, publications, evidence of collaboration in research projects comparable in type and scope, as well as references in relevant research areas or similar. All of this evidence must show that the suitability criterion has been met. Please note that the application form provided by the client must be used.
