The present call for tenders aims to identify providers of the following services in the United States of America for 2019 - 2021. The Program’s objectives are to increase awareness and consumption of European wines, and more specifically of wines with designations of origin (“DOO”) produced in the region of Bordeaux, France, and in Germany.

The tender is divided into the following Lots:

Lot 1 Press Relations: Organizing of press events and organizing of press trips to the wine regions in Germany and Bordeaux

Lot 2 Digital: Development, Maintenance and Content production of a website, Production of videos and photos that reflect the programm message

Lot 3 Advertising: Implimementation of Digital advertising campaigns i.e. on media sites and apllications as well as on social media

Lot 4 Events & POS Promotions: Implementation of Seminars, Study Trips, Tasting Events, On-Trade Tastings and POS Promotion

Befähigung zur Berufsausübung einschließlich Auflagen hinsichtlich der Eintragung in einem Berufs- oder Handelsregister

1. Cover letter, including the mention “German & Bordeaux Wines U.S. Promotion Program 2019-2021” and specifying the lot(s) in respect of which the Proposal is being submitted, dated and signed by the candidate’s duly authorized representative.

The bidder and the individual making the statement have to be named.

2.Identification form (see Schedule 1 of the Tender Documents), accompanied by proof of corporate registration

All candidates must provide documentary proof of corporate registration, according to the regulations in force in their country of residence.

3. Self-declaration on exclusion grounds in accordance with §§ 123, 124 GWB

(see Schedule 2 of the Tender Documents). The self-declaration in accordance with §§ 123, 124 GWB must be submitted and signed by every member involved in the case of a bidding consortium and/or subcontractors. The bidder and the name of the individual making the self-declaration must be given

Only those Proposals containing all information and documents specified above will be considered for the second stage of the process relating to Qualifications.

The weight of the criteria 1st, 2nd and 3rd is together 15 % (per lot).

Economic/financial qualifications and Technical/professional qualifications that are attributed less than 70% pursuant to the overall evaluation shall be deemed of insufficient quality to be considered for the final stage of the evaluation process, i.e. the evaluation of the tender on the basis of the award criteria.

Technische und berufliche Leistungsfähigkeit

4. Experience relating to the U.S. wine and spirits industry, including knowledge of the applicable legislative and/or regulatory framework

5. Experience in providing the Services in the market in respect of each lot for which a Proposal is submitted, with a supporting list and sum-mary description of major clients and programs of the last three (3) years. More specifically:

Lot 1 Press Relations

A supporting list of the candidate’s media contacts, for each of the following types of media (whether TV, radio, online and/or print):

• drinks/food (trade) media;

• specialized wine journalists;

• lifestyle media.

An indication of the relative importance (%) of the three above types of media in the candidate’s activities (in terms of time spent, experience, strength of contacts or other factors as each candidate may deem relevant);

Lot 2 Digital

Experience in website development, maintenance and optimization.

Lot 3 Advertising

Experience in media planning and buying.

Lot 4 Events & POS Promotions

A description of the candidate’s off-trade network, including a list of key accounts (importers, distributors, supermarkets, wine shops, online retailers), highlighting particularly their quality and relevance;

Knowledge of and experience with the on-trade, including a list of restaurants (independent and chained) and wine bars in Target Cities;

Knowledge of and experience with sommeliers and sommelier asso-ciations;

Experience in providing training services including training events with an experiential dimension;

Experience in organizing tasting events for professionals and con-sumers, with a strong experiential dimension;

Experience in implementing POS promotions off-trade and on-trade

6. Ability, supported by concrete examples, to provide detailed and timely estimates, invoices, performance reports and other supporting documents.

The weight of the criteria 4 is 15% (per Lot).

The weight of criteria 5 is 60% (per Lot).

The weight of criteria 6 is 10 % (per Lot).

Economic/financial qualifications and Technical/professional qualifications that are attributed less than 70% pursuant to the overall evaluation shall be deemed of insufficient quality to be considered for the final stage of the evaluation process, i.e. the evaluation of the tender on the basis of the award criteria.

Einlegung von Rechtsbehelfen

Undertakings have a right that the contracting authorities comply with the relevant provisions governing public contract award procedures in Germany that protect bidders and applicants. If an economic operator who has an interest in the contract claims that its rights have been infringed by non-compliance with the provisions governing the procedure for the award of public contracts, it shall complain to the contracting authorities within a time limit of ten calendar days (section 160(3) sentence 1 no. 1 of the German Act against Restraints of Competition (GWB)). Violations that become apparent from the tender notice or from the tender documents must be notified to the contracting authorities within the time limit specified in the tender notice for application or submission of a tender (section 160(3) sentence 1 no. 2 and 3 of the German Act against Restraints of Competition (GWB)).

If the contracting authorities notify the undertaking that it is unwilling to redress the latter's complaint, it shall be entitled to request the federal public procurement tribunal, within 15 days of receipt of such notification, to initiate review proceedings (section 160 (3) sentence 1 no. 4 of the German Act against Restraints of Competition (GWB)).

Bidders whose tenders will not be taken into account for the contract award shall be informed accordingly pursuant to section 134(1) of the German Act against Restraints of Competition. A contract must not be concluded prior to the expiry of 15 calendar days after this information has been sent by the contracting authorities; if the information is sent electronically or by fax, the time limit shall be ten calendar days. The time limit starts on the day following the sending of the information by the contracting authorities. A request for a review has to be filed in writing to the Federal Procurement Tribunal at the German competition authority, i. e.: Vergabekammern des Bundes beim Bundeskartellamt, Villemombler Straße 76, 53123 Bonn.

The language of the review proceeding is German.
